Basic Rules
These purchase and sale rules constitute a purchase-sale agreement between the buyer and Cosmomi MB.
To use the services provided by the website www.sip4skin.com, you must:
- Be familiar with the website’s privacy policy before purchasing goods or services and agree to and authorize the collection, storage, processing, and use of your personal data according to the www.sip4skin.com privacy policy.
- Be at least 14 years old.
- Provide accurate information in the registration form during the purchase, whether creating an account or purchasing as a guest (using the guest function).
- The Seller has the right to restrict the buyer’s rights on the www.sip4skin.com site due to intolerant behavior if identified.
The Seller holds all intellectual property rights to the content and visuals of the page.
- General Provisions
These Goods Purchase-Sale Rules (hereinafter referred to as the “Rules”) establish the general conditions and procedures for using the SIP4SKIN online store at www.sip4skin.com (hereinafter referred to as the “Store”). The Rules apply when Buyers select, order, and purchase goods offered by the Seller in the Store or use the services provided by the Store.
The Store is an online retail store aimed at consumers but also offering collaboration opportunities for companies upon separate request.
Only a person registered with the Store’s system or a guest (hereinafter referred to as the “Buyer”) has the right to make purchases in the Store. By registering with the Store and/or placing an order, the Buyer unconditionally confirms that they have the right to purchase from the Store. The Buyer is not entitled to place a goods order in the Store at www.sip4skin.com if they have not familiarized themselves with the Rules and/or do not agree with them. When the Buyer places an order, it is considered that the Buyer has read and agreed to the Rules. Once the Buyer places an order, the Rules constitute a Purchase-Sale Agreement between the Buyer and the Seller and are a binding legal document for both parties.
The Seller has the right to unilaterally change, amend, or supplement the Rules. The Rules applicable when purchasing from the Store at www.sip4skin.com are those in effect at the time of placing the order, so the Buyer is advised to review the Rules each time they make a purchase.
The Seller has the right, considering the technical capabilities of the Store’s system, to limit the number of registered Buyers; without prior notice to the Buyer, to restrict the Buyer’s use of the Store’s services, and to cancel the Buyer’s registration if the Buyer has used the Store in violation of these Rules, has attempted or is attempting to harm the stability and/or security of the Store or the orders executed by the Seller; to temporarily or permanently suspend the Store’s operations without prior notice to the Buyer. In the event of force majeure circumstances, the Seller has the right to suspend the fulfillment of the contract until the force majeure circumstances are resolved, notifying the Buyer of the suspension of order fulfillment. If the subsequent fulfillment of the contract is no longer relevant to the Buyer, the Buyer has the right to cancel the contract by notifying the Seller. If the Seller suspends operations but is able to fulfill confirmed orders, all rights and obligations provided in these Rules or applicable legal acts related to already fulfilled or ongoing orders remain in effect.
- Orders, Registration, Login Information
In the purchase form, the Buyer must provide the following information:
- For individuals: first name, last name; for legal entities: the name of the legal entity;
- If the Buyer is a legal entity – the legal entity code and VAT code;
- Email address;
- Address where the goods will be delivered, except in cases where the Buyer collects the goods themselves at the chosen pickup point (currently, the Store does not provide a service for picking up goods at a pickup point);
- Contact phone number.
The Seller has the right to specify additional data necessary for the delivery of goods.
The Buyer is responsible for ensuring that the information provided in the registration form is accurate and complete. If the information provided by the Buyer in the registration form changes, they must update this information without delay, but no later than before the next order. The Seller is not responsible for incorrect personal data provided by the Buyer and is not liable for any resulting damage to the Buyer or third parties.
The Buyer undertakes to keep their username and password (hereinafter referred to as “Login Information”) confidential and not disclose them to third parties. The Buyer is responsible for maintaining the security of their Login Information, as well as for any actions performed in the Store using the Buyer’s Login Information.
By registering, the Buyer grants the Seller the right to collect, accumulate, use, and process all personal data provided by the Buyer directly or indirectly during registration, visiting, and using the Store for the purposes specified in the Rules. Additionally, the Buyer grants the Seller the right to transfer the Buyer’s personal data to the Seller’s partners who jointly administer the Store with the Seller, handle the delivery of goods, or provide other services related to the Store.
The VAT invoice will be sent to the Buyer via email in electronic format – PDF.
The personal data provided by the Buyer will be processed in accordance with the requirements set by European Union laws, the Law on Legal Protection of Personal Data of the Republic of Lithuania, and other relevant legal acts of the Republic of Lithuania governing data processing and protection. The Seller will implement organizational and technical measures to ensure the protection of personal data from accidental or unlawful destruction, alteration, disclosure, or any other unlawful processing.
The Buyer’s personal data will be processed for direct marketing purposes only with the Buyer’s written, electronic, or verbal consent. The Buyer expresses their consent for the processing of personal data for direct marketing purposes by filling out the registration form and marking the relevant fields for receiving marketing material.
The Seller ensures that the Buyer’s personal data will be used exclusively by the Seller and its partners with whom the Seller collaborates in the administration of the Store, delivery of goods, and other services related to the placement or fulfillment of the Buyer’s order. - Product Prices and Discounts
In the Store, products are listed with the price of the standard unit of the product. The prices of products in the Store are indicated in euros, including VAT.
Discount codes are valid only at www.sip4skin.com, unless the promotion rules state otherwise. Only one discount code can be used per purchase. Discount codes are valid only for non-promotional items. Discounts cannot be combined, unless the promotion rules state otherwise.
The Buyer can pay for selected products using the specified payment methods.
If the Buyer does not pay for the goods within 2 (two) working days from the moment of order placement, the Seller has the right to cancel the order without prior notice to the Buyer.
An administrative fee of €2.99 is applied to orders less than €10.
The Seller has the right to change product prices without any prior notice.
- Payment Methods
You can pay for goods purchased on the online store www.sip4skin.com using the following methods:
- E-Banking: You can pay using the e-banking systems of most major Lithuanian banks through the payment platform www.montonio.com.
- Credit Cards: You can pay using VISA or MASTERCARD payment cards through the payment platform https://stripe.com/en-lt.
- Gift Vouchers: You can pay using electronic gift vouchers by entering the voucher number in the shopping cart.
- Product Quality Guarantee and Use-by Dates
The general characteristics of all products sold in the Store are provided in the product description for each item.
The Seller is not responsible for any discrepancies between the product’s color, shape, or other parameters in the Store and the actual size, shapes, and colors of the products due to the Buyer’s monitor (display) characteristics or other technical reasons, as well as for any reasonably possible appearance mismatches. If the mismatch in product color, size, or shape is caused by the Seller or third parties associated with the Seller, then the Seller is responsible for any appearance discrepancies of the product.
The Seller confirms that they are responsible for the sale of products ordered from the Store, proper delivery of purchased products, product quality, proper fulfillment of return conditions, and implementation of other rights and obligations of the Seller stipulated by legal acts.
In cases where the Seller does not provide a quality guarantee for certain types of products, the guarantee stipulated by the relevant legal acts applies.
When legal acts establish a specific use-by (expiration) date for certain products, the Seller undertakes to sell such products to the Buyer in a manner that provides the Buyer with a real opportunity to use the products until the end of the use-by date.
- Delivery and Pickup of Goods
Goods purchased in the store are delivered by the shipping service chosen by the Buyer.
The delivery time for goods, when the shipment is handed over to the shipping service, depends on the shipping service, which the Seller cannot influence. Additionally, the Seller does not guarantee that goods will always be delivered within the specified timeframe, especially if the ordered goods are not in the Seller’s warehouse, if the Buyer has provided incorrect information that needed to be corrected, if the delivery address is outside the territory of the Republic of Lithuania, or due to other factors. The Seller reserves the right to change delivery rates at their discretion.
The Buyer will be informed of the confirmed and initiated order via email.
- Contract Cancellation, Return, and Exchange of Goods
In accordance with the Civil Code of the Republic of Lithuania and the “Retail Rules” approved by the Government of the Republic of Lithuania, as well as other legal acts, a Buyer who is a natural person has the right to withdraw from a remotely concluded purchase-sale agreement and return both quality and non-quality goods purchased from the online store to the Seller.
To withdraw from a remotely concluded purchase-sale agreement and return a non-quality or quality item, the Buyer must contact the Seller within 14 (fourteen) days from the conclusion of the contract via email at info@sip4skin.com, providing a clear statement regarding the return of the goods, and specifying their name, address, phone number, the purchase date of the goods, and the name and quantity of the items to be returned. Non-quality goods are returned according to the cases and procedures stipulated by legal acts.
When returning goods to the Seller, the following conditions must be met:
- The Buyer cannot return goods that are perishable, unsuitable for return due to health protection or hygiene reasons, or goods that cannot be returned under other legal acts of the Republic of Lithuania. The Buyer must ensure that the quality, packaging, and compliance with safety and hygiene requirements of the returned goods remain unchanged.
- When returning quality goods, the Buyer is only responsible for the decrease in the value of the goods that occurs due to actions not necessary to determine the nature, characteristics, and functioning of the goods.
- The purchase document and a completed return form must be provided when returning the item.
- If items are missing from the received shipment or if the shipment does not match the order, the Buyer must notify and send a photo to email info@sip4skin.com within 1 business day of receiving the shipment.
- If the goods were sold with a discount, the amount refunded will be the amount paid after the discount.
- Gifts received with the purchase, product samples, and other items must also be returned.
- The Buyer bears the cost of return shipping.
- Shipping costs are non-refundable if the item was not picked up from the parcel locker or if delivery failed.
Upon contract cancellation (return of goods), the Buyer must send or return the goods to the Seller immediately and no later than 14 (fourteen) days from the date of notifying the Seller about the return. Goods will be exchanged or the money paid for them will be refunded to the Buyer’s account no later than 14 (fourteen) days from the date the goods are returned to the warehouse.
The Seller may withhold the Buyer’s refunded amounts until the goods are returned to the Seller or until the Buyer provides proof that the goods have been sent to the Seller. The Seller reserves the right to refuse acceptance of returned goods if the Buyer does not adhere to the return procedure specified in this section of the Rules.
- Communication
The Seller sends all notifications and contacts the Buyer using the email address or phone number provided in the Buyer’s registration form. The Buyer should send all questions and notifications to info@sip4skin.com or call +370 6 712 9079.
- Reporting Misuse
If you believe that someone is violating this Privacy Policy or the website’s usage rules, please report it to us immediately via email, phone, or other communication methods.
- Limitation of Liability
To the extent permitted by law, you are fully responsible for any losses arising from your use of our website and other services we provide. We and our team will not be liable for any indirect or consequential damages.
We and our team are not responsible for the behavior of any advertisers, linked websites, or other members.
- Compliance with Lithuanian Laws
These rules are governed by the laws of the Republic of Lithuania. All disputes arising from the implementation of these Rules are to be resolved through negotiation. The Buyer has the option to resolve disputes with the Store electronically without going to court. The Buyer must contact the Seller in writing (via email) and submit a free-form complaint regarding the goods and/or the Store or Seller’s activities. In their complaint, the Buyer must specify the particular goods or service provided by the Store that is the subject of the complaint and state their claim. Upon receiving the Buyer’s complaint, the Seller will review it within 14 (fourteen) days from the date of receipt and provide a response to the Buyer. If the Seller does not respond to the Buyer’s complaint or if the Buyer is dissatisfied with the Seller’s decision, the Buyer has the right to contact the State Consumer Rights Protection Service (Vilniaus g. 25, 01402 Vilnius, email: tarnyba@vvtat.lt, tel. +370 5 262 6751, website: vvtat.lt) (or the regional offices of the State Consumer Rights Protection Service). The Buyer can also fill out a complaint form on the ODR platform at http://ec.europa.eu/odr/ or the Consumer Rights Information System (VTIS).
